Family Educational Rights and Privacy Act (FERPA)

The Family Educational Rights and Privacy Act (FERPA) is a federal law that protects the privacy of student education records. FERPA applies to all schools that receive federal funding.

Parents and guardians have certain rights regarding their child's education records until the student turns 18 years of age or enrolls in a postsecondary institution. At that time, these rights transfer to the student, who becomes an "eligible student" under FERPA.

Under FERPA, parents and eligible students have the right to:

• Inspect and review the student's education records.
• Request the correction of education records they believe are inaccurate, misleading, or otherwise in violation of the student's privacy rights.
• Provide written consent before personally identifiable information is disclosed from education records, except as authorized by law.
• File a complaint with the U.S. Department of Education concerning an alleged failure by the district to comply with FERPA.

Directory Information

FERPA permits school districts to designate certain student information as Directory Information, which may be released without prior written consent unless a parent or eligible student chooses to opt out. Directory Information may be used for school-related purposes such as yearbooks, graduation programs, honor rolls, athletic rosters, school publications, and other district communications.

Parents and eligible students may annually opt out of the release of Directory Information by completing the Directory Information Opt-Out Form available through PowerSchool. Additional information, including the types of information designated as Directory Information, is available in Policy 515.

Access to Student Records

Parents and eligible students may request to inspect, review, or request an amendment to student education records in accordance with FERPA and district policy.
